VINCI Energies España, S.A.U. (hereinafter, VINCI Energies España), as the owner of the website www.vinci-energies.es (hereinafter, the “Website”), is committed to ensuring that your personal information is protected and not misused.

In this document we explain who the controller is depending on which Group company carries out the data processing, the purpose for which your personal information will be processed, the legitimacy for the processing, how we collect it, why we collect it, how we use it, the rights you have and also explain the processes we have put in place to protect your privacy.

By providing us with your personal information and using our websites, we understand that you have read and understood the terms relating to personal data protection information set out. VINCI Energies España, S.A.U., in its capacity as owner of the website, assumes responsibility for complying with current national and European data protection legislation, and aims to process your data in a lawful, fair and transparent manner.

COLLECTION, PURPOSE AND PROCESSING OF DATA

When a user makes use of the contact form on the website, he/she is providing personal information for which VINCI Energies España is responsible. This information may include personal data such as your IP address, name or e-mail address. By providing this information, you consent to your information being collected, used, managed and stored by VINCI Energies España only as described in the Legal Notice and this Privacy Policy.

On the Website, there is only a system for capturing personal information, in which we only process the information provided by the interested parties for the following purposes:

  • Principle of data minimisation: We will only request data that is strictly necessary in relation to the purposes for which we require it. As little as possible.
  • Principle of limitation of the retention period: The data will be kept for no longer than is necessary for the purposes of the processing, depending on the purpose, and will be deleted once the purpose is fulfilled. In the case of subscription, they will be kept until the user revokes consent.
  • Principle of integrity and confidentiality: Your data will be processed in such a way as to ensure adequate security of personal data and to guarantee confidentiality. You should be aware that we take all necessary precautions to prevent unauthorised access or misuse of our users’ data by third parties.

CATEGORY OF PERSONAL DATA

The categories of data processed are identification data. No specially protected categories of data are processed.

COMMUNICATION OF INFORMATION TO THIRD PARTIES

VINCI Energies España informs users that their personal data will not be transferred to third party organisations, with the exception of when such transfer of data is covered by a legal obligation or when the provision of a service implies the need for a contractual relationship with a data processor.

USERS’ RIGHTS

Any person has the right to obtain confirmation as to whether or not VINCI Energies España is processing personal data concerning them. Interested parties have the right to:

  • Request its rectification or deletion.
  • Request the limitation of their processing.
  • Object to the processing.
  • Request data portability.

Data subjects may access their personal data, as well as request the rectification of inaccurate data or, as the case may be, request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected. In certain circumstances, data subjects may request the limitation of the processing of their data, in which case we will only keep it for the exercise or defence of claims.

In certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their data. VINCI Energies España will stop processing the data, except for compelling legitimate reasons, or the exercise or defence of possible claims. As a data subject, you have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format, and to transmit it to another data controller when:

  • The processing is based on consent.
  • The data have been provided by the data subject.
  • The processing is carried out by automated means.

In exercising their right to data portability, data subjects shall have the right to have personal data transmitted directly from controller to controller where technically feasible. In turn, they also have the right to effective judicial protection and to lodge a complaint with the supervisory authority, in this case the Spanish Data Protection Agency, if they consider that the processing of personal data concerning them is in breach of the Regulation.

In order to exercise these rights, the user must contact the data controller, identified in point 2 of this document, by e-mail or post. In order to be able to respond to your request, you must also provide us with your name and surname, documentation accrediting your identity (ID card or passport) and the address at which you wish to receive a reply.

The exercise of rights must be carried out by the user himself. However, they may be exercised by a person authorised as the authorised person’s legal representative. In this case, documentation must be provided that accredits this representation of the interested party.

DATA SECRECY AND SECURITY

VINCI Energies España undertakes to use and process the personal data of users, respecting their confidentiality and to use them in accordance with their purpose, as well as to comply with its obligation to store them and to adapt all measures to avoid their alteration, loss, unauthorised processing or access, in accordance with the provisions of current data protection legislation.

VINCI Energies España cannot guarantee the absolute impregnability of the Internet network and, therefore, the violation of data through fraudulent access to them by third parties.

With respect to the confidentiality of the processing, VINCI Energies España will ensure that any person who is authorised to process the user’s data (including its staff, collaborators and service providers) will be under an appropriate obligation of confidentiality (whether a contractual or legal duty).

When a security incident occurs, upon becoming aware of it, VINCI Energies España shall notify the user without undue delay and shall provide timely information related to the security incident in a transparent manner or upon the user’s reasonable request.

ACCURACY AND TRUTHFULNESS OF DATA

The user is solely responsible for the veracity and accuracy of the data submitted on the Website, exonerating VINCI Energies España from any liability in this regard.

Users guarantee and are responsible, in any case, for the accuracy, validity and authenticity of the personal data provided, and undertake to keep them duly updated. The user agrees to provide only complete and correct information in the contact or subscription form.

ACCEPTANCE AND CONSENT

The user declares to have been informed of the conditions on the protection of personal data, accepting and consenting to the processing of the same by VINCI Energies España in the manner and for the purposes indicated in this privacy policy.

REVOCABILITY

The consent given, both for the processing and for the transfer of the data of the interested parties, may be revoked at any time by notifying VINCI Energies España in the terms established in this Policy for the exercise of their rights. This revocation shall in no case be retroactive.

CHANGES TO THE PRIVACY POLICY

VINCI Energies España reserves the right to modify this policy to adapt it to new legislation or jurisprudence, as well as to industry practices. In such cases, VINCI Energies España will announce on this page the changes introduced reasonably in advance of their implementation.

COMMERCIAL MAILINGS

In accordance with the LSSICE, VINCI Energies España does not engage in SPAM practices, and therefore does not send commercial e-mails by electronic means that have not been previously requested or authorised by the user.

In accordance with the provisions of Law 34/2002 on Information Society Services and Electronic Commerce, VINCI Energies España undertakes not to send commercial communications without duly identifying them.
